1809 Lease of Cottages

The 1809 lease of Cottages in Preston Plucknett

 

This is a lease in the Heritage Centre, Taunton, dated 28 September 1809 and made between John Goodford Esq and Emanuel Pester for several cottages in Preston Plucknett.



This Indenture made the twenty eighth Day of September in the Fortyninth Year of the Reign of our Sovereign Lord George the Third by the Grace of God of the United Kingdom of Great Britain and Ireland King Defender of the Faith and in the Year of our Lord one Thousand eight Hundred and nine Between John Goodford of Yeovil in the County of Somerset Esquire only Son and Heir of John Old Goodford late of Yeovil aforesaid Esquire deceased by Maria his Wife of the one part and Emanuel Pester of Preston Plucknett in the same County Gentleman of the other part Witnesseth that for and in Consideration of the Sum of five Shillings of lawful Money of the United Kingdom of Great Britain and Ireland current in England to him the said John Goodford in hand well and truly paid by the said Emanuel Pester at or before the Sealing and Delivery of these presents the Receipt whereof is hereby acknowledged We the said John Goodford hath bargained and sold and by these presents doth bargain and sell unto the said Emanuel Pester his Executors administrators and Assigns All that Cottage or Dwelling House with the little Garden to the same belonging situate and being in Preston Plucknett aforesaid and now in the possession of Samuel Edwards as Tenant to the said John Goodford And also all that Cottage or Dwelling House with the little Garden to the same adjoining and belonging situate and lying in Preston Plucknett aforesaid formerly in the possession of Elizabeth Eden deceased, since of Samuel Gyles deceased but now of Elizabeth Gyles and adjoining to the before mentioned Cottage on the West And also all that Cottage or Dwelling House with the Garden and Backside thereunto belonging situate lying and being in Preston Plucknett aforesaid formerly in the possession of Robert Roe, since of John King deceased but now of William King and adjoining to the east mentioned Cottage on the West And also all that Cottage with the Garden and Backside thereunto belonging   situate lying and being in Preston Plucknett aforesaid formerly in the possession of George Lane since of Elizabeth Ostler Spinster deceased, but now of Mary Ostler and George Terrel and adjoining to the ^said last mentioned Cottage on the West And also all that Cottage or Dwelling House with the Garden and Backside to the same belonging situate lying and being in Preston Plucknett aforesaid and now in the possession of Richard Hann as Tenant to the said John Goodford and also adjoining to the last mentioned Cottage on the West All which said Cottages and Premises are bounded on the East and North by Lands of the said Emanuel Pester, on the West by a Cottage belonging to Mr. Butler and on the South by the Turnpike Road leading from Yeovil aforesaid to Odcombe in the County of Somerset Together with all Houses Outhouses Edifices Buildings Trees Woods Underwoods Hedges Ditches Ways Paths Passages Waters Watercourses Easements Profits Commodities Hereditaments and Appurtenances whatsoever to the said Cottages or Dwelling Houses Gardens and Premises or any part or parcel thereof belonging or in any wise appertaining And the Reversion and Reversions Remainder and Remainders yearly and other Rents Issues and Profits thereof and every part and parcel thereof To have and to hold the said Cottages or Dwelling Houses Gardens and Premises above mentioned and hereby bargained and sold or intended so to be and every part and parcel thereof with their and every of their of Rights Members and Appurtenances unto the said Emanuel Pester his Executors Administrators and Assigns from the day next before the Day of the Date of these Presents for and during and unto the full End and Term of one whole Year from hence next ensuing and fully to be complete and ended Yielding and Paying therefore unto the said John Goodford his Heirs and Assigns the yearly Rent of one pepper Corn only on the last Day of the said Term of the same shall be lawfully demanded To the Intent that the said Emanuel Pester by virtue of these presents and by force of the Statute made for transferring Uses into Possession may be in the actual Possession of the said Cottages or Dwelling Houses Gardens and Premises hereby bargained and sold or intended so to be with their appurtenances and thereby be enabled to accept and take a Grant and Release of the Reversion and Inheritance thereof to him and his Heirs and Assigns for Ever in and by a certain Indenture already prepared and intended to bear date the Day next after the Day of the Date of these Presents and to be made between the said John Goodford of the one part and the said Emanuel Pester of the other part In Witness whereof the said parties to these presents have hereunto set their Hands and Seals the Day and Year first above written
