1810 Sale of The Sun inn

The 1810 sale of the Sun Inn in Grope Lane

 

This is an indenture in my collection dated 2 August 1810 between Edmund Batten (who, in 1807, had acted for Henry Lillington), and Mary Nossiter, for the sale of a property in Grope Lane (today's Wine Street) - the Sun Inn. I'm no legal expert, but it would appear that Henry Lillington defaulted on payment.



 

This Indenture made the second day of August in the year of our Lord One Thousand Eight Hundred and ten Between Mary Nossiter of Yeovil in the county of Somerset Widow of the one part and Edmund Batten of the same place Gentleman of the other part Whereas by indenture of Mortgage of three parts bearing date on or about the second day of August in the year of our Lord One Thousand Eight Hundred and Seven and made or expressed to be made between the said Edmund Batten of the first part Henry Lillington of Yeovil aforesaid Victualler of the second part and the said Mary Nossiter of the third part Reciting that the said Edmund Batten was seised in Fee simple of the Messuage or Dwellinghouse and premises thereinafter described and intended to be thereby demised In Trust for the said Henry Lillington his heirs and assigns And also reciting that the said Mary Nossiter at the request of the said Henry Lillington had agreed to advance and lend him the sum of Two Hundred pounds on the security of the said premises It is witnessed that in consideration of the sum of Two hundred pounds to the said Henry Lillington and of the sum of Five Shillings to the said Edmund Batten in hand severally paid by the said Mary Nossiter as therein is mentioned the said Edmund Batten at the request and by the direction and appointment of the said Henry Lillington [word illegible] as therein is mentioned did bargain sell and devise and the said Henry Lillington did grant bargain sell and devise ratify and confirm unto the said Mary Nossiter her executors administrators and assigns All that Messuage or Dwellinghouse Burgage and Inn commonly called or known by the name or the sign of the Sun situate and being in Grope-lane in the parish of Yeovil aforesaid and in the said Indenture and hereinafter more particularly described with the appurtenances To hold the same unto the said Mary Nossiter her executors administrators and assigns from the day next before the day of the date of the now reciting Indenture for and during and unto the full end and term of One Thousand years thence next ensuing and fully to be complete and ended without impeachment of waste Under the yearly rent of a pepper-corn payable as therein is mentioned and Subject to a proviso therein contained for redemption of the said premises on payment by the said Henry Lillington his heirs executors administrators and assigns unto the said Mary Nossiter her executors administrators and assigns of the sum of Two Hundred pounds with legal Interest for the same on a certain day therein mentioned and since past And whereas the said the said Henry Lillington by a certain promissory note under his hand bearing date the first day of the said Month of August One Thousand Eight Hundred and seven did promise to pay unto the said Mary Nossiter or her [order?] twelve months after the date of such note the sum of One Hundred pounds for value received as in and by the said [scited?] Indenture of Mortgage and Promissory Note [word illegible] thereunto respectively had will more fully appear And whereas there now is and remains justly due and owing from the said Henry Lillington to the said Mary Nossiter for Principal and Interest on or by virtue of her said recited securities the sum of Three Hundred and Fifteen Pounds Now this Indenture witnesseth that for and in in consideration of the sum of Three Hundred and Fifteen Pounds of lawful money of English value and currency to the said Mary Nossiter in hand paid by the said Edmund Batten at or before the sealing and delivery of these presents the receipt whereof the said Mary Nossiter doth hereby acknowledge and thereof acquit and discharge the said Edmund Batten his executors administrators and assigns by these presents She the said Mary Nossiter hath bargained sold assigned and confirmed and by these presents doth bargain sell assign and confirm unto the said Edmund Batten his executors administrators and assigns All that the said Messuage or Dwellinghouse Burgage and Inn commonly called or known by the name or sign of the Sun situate and being in in Grope lane within the parish of Yeovil aforesaid late in the possession of the said Mary Nossiter and now of the said Henry Lillington or their respective undertenants together with all [houses ?] Outhouses edifices buildings stables cellars courtyards ways paths passages waters watercourses [word illegible] profits advantages and appurtenances whatsoever to the said Messuage or Dwellinghouse and premises belonging or in any wise appertaining or now or at any time heretobefore had held used occupied possessed or enjoyed or reputed deemed taken or known as or to be part parcel or mainder thereof or belonging thereto and the reversion and reversions remainder and remainders rents issues and profits thereof and all the estate right title interest property claim and demand whatsoever at law and in equity of her the said Mary Nossiter of in to and out of the same premises and every part thereof together with the said Sum of Three Hundred and Fifteen Pounds now due and owing on the said Indenture of Mortgage and Promissory note and all and every other sum and sums of money now due and payable and which shall hereafter become due and payable by virtue thereof To have and to hold the said Messuage or Dwellinghouse Burgage and Inn and all and singular other the premises hereby assigned or mentioned or intended so to be and and every part thereof with with the appurtenances unto the said Edmund Batten his executors administrators and assigns from henceforth for and during all the now residue and remainder of the said Term of One Thousand years in the same premises now to come and unexpired Subject nevertheless to redemption as hereinbefore is mentioned And the said Mary Nossiter for herself her heirs executors and administrators doth hereby covenant promise and agree to and with the said Edmund Batten his executors administrators and assigns that she the said Mary Nossiter hath not done committed or suffered and act matter or thing whatsoever whereby or in consequence whereof the said two several principal Sums of Two Hundred Pounds and One Hundred Pounds with the interest thereon respectively amounting together to the sum of Three Hundred and Fifteen pounds now are and remain justly due and payable upon or by virtue of the above recited securities And lastly that she the said Mary Nossiter her executors and administrators shall not nor will (unless it be at the request of the said Edmund Batten his executors administrators or assigns) release or discharge the money now due or hereafter to become due upon the said Indenture of Mortgage and Promissory note or either of them or any part thereof or disavow or become nonsuit in any action or suit to be brought or prosecuted on the same or either of them or do or willingly suffer any act matter or thing whatsoever whereby or in consequence whereof the money respectively payable upon the said Indenture of Mortgage and Promissory note or either of them shall not be recovered or received by him the said Edmund Batten his executors administrators or assigns according to the true intent and meaning of these presents In Witness whereof the said parties to these presents have hereunto interchangeably set their hands and seals the day and year first above written.
