1731 Will of Samuel  Goodford

In the Name of God Amen I Samuel Goodford of Yeovil in the County of Somerset Glover doe make and appoint this to be my last Will and Testament in manner following Imprimis I give and bequeath unto Mr John Milner the sume of Four pounds a year to be paid him as long as he shall continue pastor or Teacher of the Dissenting Congregation of Protestant Dissenters in Yeovil aforesaid and no longer Item I give devise and bequeath unto my son Samuel Goodford and the heirs of his body and to his Executors Administrators and assigns All my real and personal Estate paying my Debts and the Legacies hereby bequeathed Imprimis I give and bequeath unto my Wife three hundred pounds and in Case I have no Child by her living at the time of my death or she is not with Child at that time then I make that three hundred pounds the sume of one Thousand pounds Item I give my Mother Ten pounds Item I give and bequeath unto my two Daughters Ann and Elizabeth the sume of Three Thousand pounds equally to be divided between them to be paid them at their respective ages of One and Twenty years or at the day of their respective Marriage And if either of the Dye before she attains the age of One and Twenty years and unmarried then the survivor of them to have the sume of Two thousand pounds part of the said Three Thousand pounds and if both my said Daughters shall happen to dye before they attain the age of One and Twenty years and unmarried then the sumes before given to my Daughters shall be and remain unto my son Samuel Goodford and in the meantime the said Sume of three Thousand pounds to be placed out at Interest upon Government or other Securities for the benefit and Advantage of my said Daughters in manner and proportion as herein before bequeathed and I hereby direct that the Education and maintenance of my said Daughters shall be provided for and discharged out of the Interest and produce of the said Three Thousand pounds or two Thousand pounds as the same shall happen to arise or be payable under this my Will and such Maintenance and allowance therefore to be at the discretion of my executors herein after named Item and I hereby will direct and appoint that the sumes of money given to my daughters as aforesaid shall be in Leiu and Satisfaction of any provision heretofore made in my marriage Settlement made upon my first marriage and if my said Daughters shall refuse to accept the said three Thousand pounds or two Thousand pounds as hereby bequeathed in full satisfaction and Recompence of any such provision that they then hall not be Intitled to the said Three Thousand pounds in this my Will bequeathed or to any part of the same And if either of my said Daughters shall so refuse that such Daughter shall not be Intitled to any share or part of the Three Thousand pounds given by this my Will or of the Interest or produce thereof but the share of her so refusing together with the Interest and Produce thereof shall go to my Son Samuel and if my Son Samuel shall dye before he attain his age of one and Twenty years and with[ou]t Issue Then and in such Case If I leave a son by my now Wife or my Wife shall be with Child of a Son I give devise and bequeath unto such Son and to the heirs of his body and to his Executors Adm[inistrato]rs all my real and personal Estate Subject to the paym[en]t of the Legacies herein before bequeathed And in Case such Son shall happen to dye before he attain his age of one and Twenty years and with[ou]t Issue and I shall have a Daughter by my now Wife or if she shall be with Child of a Daughter at the time of my death then I give and bequeath unto my Daughters Ann and Elizabeth the sum of four Thousand pounds each but still in Leiu and satisfaction of any provision heretofore made upon my marriage for Daughters younger Children or Heirs Female and after the payment of the said four Thousand pounds to each of my said Daughters Ann and Elizabeth Then I give devise and bequeath unto my said Daughters Ann and Elizabeth and to such hereafter to be born Daughter All my real and personal Estate To hold to them and their heirs and my mind and Will is that if either of my said Daughters Ann and Elizabeth or such hereafter to be born Daughter shall happen to dye before they attain the age of one and Twenty years and without Issue then the share and proportion of such Daughter soe dying both of my real and personal Estate shall goe to such surviving Daughter and Daughters and their Heirs Executors Adm[inistrato]rs and Assigns And if my Daughters Ann and Elizabeth shall refuse and not accept of the provision hereby made in case I dye with[ou]t a Son or my Wife shall not be with Child of a Son at the time of my death and my said Daughters Ann and Elizabeth shall take under the settlement made upon my first marriage then my mind and Will is that such hereafter born Daughter shall take such part of the residue and remainder of my Estate both real and personal which shall together with the provision made upon the marriage of my now Wife for Child or Children as shall make all my Daughters of equal fortune and that in case either of them dye before the attainment of the age of One and Twenty years and without issue that the share proportion of such Daughter or Daughters so dying shall go to the Surviving Daughter and Daughters their Heirs and assigns And if all my Daughters which I now have or hereafter may have shall dye before the attainment of their respective ages of One and Twenty years and with[ou]t issue and I shall leave no Issue at the time of my death or my Wife shall not be with Child at the time of my death or if she is and such Child shall happen to dye before the age of Twenty and one years and without Issue Then I give and devise unto my son in Law John Old his Heirs Executors Adm[inistrato]rs and Assigns all my Estate whether Fee Simple or for any number or Term of years situate lying and being in Marston Magna als[o] Broad Marston in the County of Somerset aforesaid and all other my Real Estate I give and devise unto my Nephew Ambrose Seaward for and during the Term of his natural life and after his decease To the first son of the body of the said Ambrose Seaward lawfully to be begotten and to the Heirs Male of the body of such first Son and in default of such Issue to the second Third Fourth Fifth Sixth seventh and all and every other son and sons of the body of the said Ambrose Seaward lawfully to be begotten and to the Heirs Male of the body and bodies of such second and every other son and sons as they shall be in Seniority of age and priority of Birth and in Default of such Issue I give and devise such Estate unto my son in law John Old for and during the Term of his natural life and from and after his decease to the first son of the body of the said John Old lawfully to be begotten and to the Heirs Male of the body of such first Son lawfully Issueing and in default of such Issue to the second Third Fourth Fifth Sixth seventh and all and every other the son and sons of the body of the said John Old lawfully to be begotten and to the Heirs Male of the body of such Son and Sons to be taken as they shall be in Seniority of age and Priority of Birth and in default of such Issue to my own right heirs for ever And I likewise bequeath my personal Estate the use thereof unto Ambrose Seaward and to John Old in such manner as my Real Estate is Limited to them and to my Right heirs And I subject my real and personal Estate in the hands of the said Ambrose Seaward when hee shall take the said Estate or when my Son John Old take the said Estate unto the payment of the sumes of money herein after mentioned that is to say to the payment of my Debts To my Wife the sume of five Thousand pounds To my Neices Elizabeth Ann Gertrude And Mary Everton the sume of One Thousand pounds share and share alike To the two Daughters of my Sister Seaward Two hundred pounds To the Three Children of my Sister Waddon deceased One hundred pounds each To my Mother One Yearly annuity of fifty pounds during her Natural Life Item And I commit the Guardianship and Tuition of my Son and Daughters to my Executors and Trustees herein after named and that they shall lay out and expend any sum and sums of money in and about their Education and placeing my Son Samuel Goodford out an Apprentice as they in their discretion shall think proper And my mind and Will is that if I leave a Child by my now Wife or leave her with Child that such Child be paid during the life of my said Wife if my Son Samuel shall so long live Forty pounds a year for the Education and maintenance of such Child Item and I constitute and appoint my Wife my Brother in Law Mr Jeremiah Hayne and Mr Edward Butcher of Yeovil aforesaid Glove Dyer Executors of this my last Will and Testament during the minority of my Son Samuel Goodford And I appoint them and the survivors of them Guardians of my Children And I give them Twenty pounds each for mourning and that they retain to each of themselves out of the Profits of my Real Estate the yearly sum of Ten pounds during the continuance of the Trust in them hereby reposed for their care and trouble in the same In Witness whereof I have to this my Will wrote on Six sheets of paper to each of which I have subscribed my Name And to the sixth and last set my hand and seal this 27th day of Octob[er] in the year 1731

On which day appeared personally James Samson of the Inner Temple London Esquire who being sworn on the Holy Evangelists to depose the truth did depose and say that he knew and was well acquainted with Samuel Goodford late of Yeovil in the County of Somerset Glover deceased that he this Deponent drew and wrote the last Will and Testament of him the said deceased (except the day and month of the date thereof) hereunto annexed and bearing date on the Twenty seventh day of the month of October and in the year of Our Lord one thousand seven hundred Thirty and one and that before the Execution of the said Will He this Deponent by the order and direction of him the said Samuel Goodford at the time of reading the said Will over to him did then with a Pen and Ink Scratch or blot out the words five hundred in the Fourteenth Line of the first sheet of the said Will and did write or Interline the words One Thousand instead thereof in the very manner and form it now appears thereon

This Will was proved at London the Eighteenth day of November in the year of Our Lord One Thousand Seven hundred thirty five before the Worshipful Edward Kingston Doctor of laws Surrogate to the Right Worshipful John Bettesworth Doctor also of laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the oaths of Elizabeth Goodford Widow the Relict Jeremiah Hayne and Edward Boucher otherwise Butcher Executors according to the [Tenour?] of the said Will To whom Administration was granted of all and singular the Goods Chattels and Credits of the said deceased being firt sworn duly to administer
