1793 Sale of The Sun inn

The 1793 sale of the Sun Inn in Grope Lane

 

This is an indenture in my collection dated 21 October 1793, for the sale of the Sun Inn in Grope Lane (today's Wine Street) by Thomas Tompkins, Grace Farley and Lionel Farley Jnr to widow Sarah Leveridge.



 

This Indenture of three parts made the twenty first day of October in the year of our Lord One thousand seven hundred and ninety three and in the Twenty fourth year of the reign of our Sovereign Lord George the Third by the grace of God of Great Britain France and Ireland King Defender of the faith and so forth Between Thomas Tompkins of Yeovil in the County of Somerset Cooper Devisee in fee under the last Will and Testament of Lionel Farley late of the same place Innholder deceased in respect of the Messuage or Dwelling-house hereinafter expressed to be hereby deceased of the first part Grace Farley of Yeovil aforesaid Widow and relict of the said Lionel Farley deceased and Lionel Farley of the same place Tiler and Plasterer Eldest Son and Heir at Law of the said Lionel Farley deceased of the  second part And Sarah Leveridge of Yeovil aforesaid Widow of the third part Whereas the said Lionell Farley deceased in and by his last Will and Testament in writing bearing date the fifth day of November one thousand seven hundred and eighty five executed and attested on oath [word illegible] and as by law prescribed for [passing?] real estates Did give and devise unto the said Thomas Thompkins amongst other hereditaments his heirs and assigns All that the said Testators Messuage or Dwelling house with the stables and appurtenances to the same Belonging situate in Yeovil aforesaid being a Public house or Inn and known by the sign of the Sun Upon trust that he the said Thomas Tompkins his heirs and assigns [word illegible] as soon as conveniently might be after the said Testators decease sell and dispose of the said messuage or dwelling house to the purchaser or purchasers that could or might be gotten for the same and by and out of the money arising by such sale all the first peace to pay and satisfy all the Testators just debts and after payment thereof Upon trust to apply the remainder of the said purchase money in such manner as therein is mentioned And Whereas the said Testator hath since departed this life without altering or revoking his said Will And Whereas the said Thomas Tompkins in pursuance of the [word illegible] reposed in him in and by the said [four words illegible] and agree with the said Sarah Leveridge for sale to her of the fee simple and inheritance of the said messuage or dwelling house and Inn at or for the price or sum of Two Hundred and Forty Pounds Now this Indenture Witnesseth that for and in consideration of the sum of Two Hundred and Forty pounds of lawful money of Great Britain to the said Thomas Tompkins in hand paid by the said Sarah Leveridge at or before the sealing and delivery of these presents the receipt whereof the said Thomas Tompkins doth hereby acknowledge and thereof acquit and discharge the said Sarah Leveridge her heirs executors administrators and assigns by these presents and in consideration of five shillings to each of them the said Grace Farley and Lionel Farley party hereto at the same time paid by the said Sarah Leveridge the receipts whereof are hereby acknowledged He the said Thomas Tompkins Hath bargained sold released and conveyed and by these presents Doth bargain sell release and convey and the said Grace Farley and Lionel Farley party hereto Have and each of them Hath released ratified and confirmed and by these presents Do and each of them Doth release ratify and confirm unto the said Sarah Leveridge in her actual possession so being by virtue of a bargain and sale to her thereof made in consideration of five shillings by Indenture bearing date the day next before the day of the date of these presents for one year commencing from the day next before the day of the date of the same Indenture of Bargain and Sale and by force of the Statute made for transferring of uses into possession and her heirs All that before mentioned messuage or dwelling house Burgage and Inn commonly called or known by the name or sign of the Sun situate and being in Grope Lane within the Borough of Yeovil aforesaid heretofore in the possession of Edward Hopkins afterwards of John Hopkins since of Henry Priddle late of the said Lionel Farley deceased and now of the said Grace Farley or their respective undertenants together with all houses outhouses edifices buildings stables cellars courtyards ways paths passages waters watercourses easements profits advantages  and appurtenances to the said messuage or dwelling house and premises belonging or in any wat appertaining or now or at any time heretofore had held used occupied possessed or enjoyed or reputed [word illegible] taken or known as or to be part parcel or [inclusive?] thereof or belonging thereunto and the reversion and reversions remainder and remainders rents issues and profits thereof and all the estate right interest property claim and demand whatsoever at law and in Equity of them the said Thomas Tompkins Grace Farley and Lionel Farley party hereto, any or either of them of in to or out the same premises and also all deeds Evidences and writings whatsoever which relate to or concern the said premises now in the [custody?] or power of them the said Thomas Tompkins and Grace Farley or either of them or which they or either of them call or may obtain without suit at Law or in Equity to be holden of the Chief Lord or Lords of the fee of the said [abbreviated word illegible] by and under the rents and services therefore due and of right [word illegible] paid

To have and to hold the said Messuage or dwelling and all and singular other the premises hereby released and conveyed or intentioned or intended so to be and every part thereof with the appurtenances unto the said Sarah Leveridge her heirs and assigns To the sole and proper use of the said Sarah Leveridge her heirs and assigns for ever And the said Thomas Tompkins for himself his heirs executors and administrators doth hereby covenant promise and agree to and with the said Sarah Leveridge her heirs and assigns in manner following, that is to say, that for and notwithstanding any act matter or thing [two words illegible] committed or suffered to the contrary he the said Thomas Tompkins hath at the time of the sealing and delivery of these presents good right power and lawful and absolute authority to grant and convey the said messuage or dwellinghouse and premises with the appurtenances unto the said Sarah Leveridge heirs and assigns according to the full interest and meaning of these presents And also that it shall and may be lawful to and for the said Sarah Leveridge heirs and assigns from time to time and at all times hereafter peaceably and quietly to enter into have hold and occupy possess and enjoy the said messuage or dwelling-house and premises with the appurtenances and the rents issues and profits thereof to receive and take to her and their own use without any the lawful let suit trouble interruption or disturbance of or by the said Thomas Tompkins his heirs or assigns or any other person or persons claiming or to claim by from or under him or them And that free and clear and freely and clearly exonerated and discharged or otherwise well and sufficiently saved and kept harmless and indemnified by the said Thomas Tompkins his heirs executors and administrators of from and against all and all manner of [word illegible] and other gifts grants bargains sales leases mortgages [two words illegible] uses wills judgments extents committed or suffered or to be had made done committed or suffered by the said Thomas Tompkins or by any other person or persons lawfully claiming or to claim by from or under the said Lionel Farley deceased other than and except the remainder of a certain term of five hundred years [word illegible] and raised in the said premises on or about the ninth day of May in the year of our Lord one thousand seven hundred and fifty five and which by Indenture tripartite bearing date the twenty eighth day of November one thousand seven hundred and sixty made or mentioned to be made between Henry Priddle of Tintinhull in the said county of Somerset yeoman of the first part the said Lionel Farley deceased of the second part and John King of Yeovil aforesaid Stationer of the third part was assigned to the said John King In trust for the said Lionel Farley deceased and which is hereby declared and agreed by and between all the said parties to these presents in from [several words illegible] and be in the said John King in trust for the said Sarah Leveridge her heirs and assigns And it is hereby further declared and agreed by and between all the said parties to these presents that all and every devise lease or grant at any time heretofore created and [raised?] of or in the said hereby declared premises shall from henceforth wait and attend on the [word illegible] and maintenance of the said premises in order to protect and defend the same from all [two words illegible] and therefore to be from time to time transferred and assigned to such person or persons as the said Sarah Leveridge her heirs or assigns shall nominate direct or appoint And Lastly that he the said Thomas Tompkins and his [heirs?] and all and every other person or persons having or lawfully claiming or who shall or may at any time or times hereafter have or lawfully claim any Estate right or interest at law or in Equity of in to or out of the said messuage or dwelling-house and premises hereinbefore expressed to be hereby [word illegible] or any part thereof from by in or under the said Lionel Farley deceased shall and will from time to time and at all times hereafter upon every reasonable request and at the proper costs and charges of the said Sarah Leveridge her heirs or assigns make do acknowledge suffer and execute or cause and procure to be made done acknowledged [word illegible] suffered and executed all and every such further and other lawful and reasonable acts and things conveyances and assurances in the law whatsoever for the better and more effectually conveying and assuring of the same premises hereinbefore expressed to be hereby conveyed with the appurtenances unto and to the use of the said Sarah Leveridge her heirs and assigns according to the true intent and meaning of these presents as by the said Sarah Leveridge her heirs or assigns or her or their Counsel learned in the Law shall be devised or advised and required In Witness whereof the said parties to these presents have hereunto interchangeably set their hands and seals the day and year first above written
