1803 will of Hannah Donn

Widow

 

This is the last Will and Testament of me Hannah Donn of Yeovil in the County of Somerset Widow I give and devise all my Estate Lands and Hereditaments situate in the Parish of Sutton Montis in the said County to Robert Donn of the City of Exeter Gent[leman] and Henry Penny of Yeovil aforesaid Glover To hold to them the said Robert Donn and Henry Penny their Heirs and Assigns forever upon Trust that they the said Robert Donn and Henry Penny and the Survivor of them and the Heirs and Assigns of such Survivor do and shall (until my great Nephew William Henry Lewis Son of my Nephew George Lewis late of the City of London Linen Draper deceased by Sarah his Wife shall attain the age of Twenty one Years) receive the Rents Issues and Profits of the same Premises and place the same out at Interest to the intent that the same may accrue at for the benefit of the said William Henry Lewis until the said William Henry Lewis shall attain the said Age of Twenty one Years and on his attaining that Age hereby give and bequeath such Rents Issues and Profits together with the accumulated Interest therein to the said William Henry Lewis his Executors Administrators and Assigns but in case the said William Henry Lewis shall happen to die under the said Age of Twenty one Years I give and bequeath the same Rents Issues and Profits with the accumulated Interest thereon unto the said Henry Penny and his Sister Elizabeth Penny of Yeovil aforesaid Spinster and it is my Will and I do hereby declare and direct that the said Robert Donn and Henry Penny their Heirs and Assigns shall stand seized of the said Estate Lands and Hereditaments to for and upon the uses Trusts intents and purposes herein after mentioned and expressed that is to say To the use and behoof of the said William Henry Lewis  and his Assigns for and during the term of his natural life without impeachment of Waste and from and after the determination of that Estate To the use of the said Robert Donn and Henry Penny and their Heirs during the life of the said William Henry Lewis In trust to preserve the contingent Uses and Estates hereinafter limited from being defeated or destroyed and for that purpose to make [entries?] and bring Actions as occasion shall require yet nevertheless to permit and suffer the Rents and Profits of the same Premises to be received by the said William Henry Lewis  and his Assigns for and during the Term of his natural life and from and immediately after the decease of the said William Henry Lewis To the use and behoof of the first Son of the Body of the said William Henry Lewis  lawfully to be begotten and the Heirs of such first Son lawfully begotten if [words illegible] in default of such Issue To the use and behoof of the second third fourth and all and every other Son and Sons of the Body of the said William Henry Lewis  lawfully to be begotten severally successively and in remainder one after another in order and in course as they and each of them shall be in Seniority of Age and Priority of Birth and the several and respective Heirs of the Body and Bodies of all and every such Sons and Son lawfully issuing the [elder?] of such Son and Sons and the Heirs of his and their Body and Bodies lawfully issuing being always to be preferred and to take before the Younger of such Son and Sons and the Heirs of his and their Body and Bodies lawfully issuing and in default of such Issue to the use and behoof of all and every the Daughters and Daughter of the Body of the said William Henry Lewis  lawfully to be begotten equally to be divided between them or amongst them if more than one share and share alike and they to take as Tenants in Common and not as joint Tenants and the Heirs of the Body and Bodies of all and every such Daughter and Daughters issuing and if there shall be a failure of Issue in any such Daughter and Daughters then as to the Part or Share or Parts or Shares of such Daughter and Daughters whose Issue shall so fail To the use of the remaining or other of the said Daughters equally to be divided between them (if more than one) share and share alike and they to take as Tenants in common and not as joint Tenants and the Heirs of their respective Bodies issuing and in case there shall be a failure of Issue of all such Daughters but one or if there shall be but one such Daughter there to the use of such remaining or only Daughter and the Heirs of her Body and in default of such Issue Then to the use of the said Henry Penny and Elizabeth Penny their Heirs and Assigns for ever as Tenants in Common and not as joint Tenants I give and bequeath to my Servant Maid Mary Thorn One annuity or clear Yearly Sum of Twenty Pounds to be paid her by my Executors hereinafter named for and during the term of her natural life by two equal half yearly payments on the Twenty fifth day of March and the Twenty ninth day of September in every year the first payment to be made on such of the said days as shall happen next after my decease And whereas in and by the last Will and Testament of my late Husband Henry Donn deceased he the said Henry Donn gave me the Sum of One thousand Pounds to dispose of by Will to his the said Henry Donns Relations Now I the said Hannah Donn in pursuance of my late Husbands Will do give bequeath and dispose of the said Sum of One Thousand Pounds amongst the Relations hereinafter next mentioned of my said late Husband in manner following that is to say I give and bequeath unto Charles Upton of Yeovil aforesaid Gentleman the Sum of One hundred Pounds of lawful Money of Great Britain I give and bequeath unto Elizabeth Upton of Yeovil aforesaid Spinster the like Sum of One hundred Pounds I give and bequeath to her Sister Harriet Upton the Sum of One hundred and Fifty Pounds I give and bequeath to Unice Shorland Daughter of Thomas Shorland of Yeovil aforesaid Surgeon the Sum of One hundred Pounds To Elizabeth Shorland her Sister the like Sum of One hundred Pounds To Thomas Shorland the Younger of Yeovil aforesaid Surgeon the like Sum of One hundred Pounds and to his Brother John Shorland the Sum of Fifty Pounds I give and bequeath to Edward Boucher (Son of William Boucher of the City of London Gentleman) the Sum of One hundred Pounds and to Newman Hay Boucher (another son of the said William Boucher) the like Sum of One hundred Pounds I give and bequeath to the said Robert Donn ) the Sum of One hundred Pounds which said several Legacies (making together the said Sum of One thousand Pounds so given to me as aforesaid by the said Will of my said late Husband) I hereby direct to be paid to the several Legatees respectively by my said Executors in twelve Months next after my decease I give and bequeath to my Cousin Ann Uphill daughter of John Uphill of Charlton Horethorne in the said County of Somerset Yeoman the Sum of One hundred Pounds I give and bequeath to my Servants John Hodges and Isaac Lawrence the Sum of Ten Pounds a piece I also give and bequeath to such other Maid Servant as may be living with me at the time of my decease besides the said Mary Thorn the like Sum of Ten Pounds which said several last mentioned Legacies I hereby direct to be paid to the said Legatees respectively by my said Executors in Six Months next after my decease All the rest residue and remainder of my Goods Chattels Monies and all other my Personal Estate whatsoever and wheresoever I give and bequeath to the said Henry Penny and Elizabeth Penny their Executors Administrators and Assigns to be equally divided between them share and share alike And I appoint the said Robert Donn and Henry Penny joint Executors of this my Will and I do revoke and make void all former Wills by me at any time heretofore made and declare this only to be my last Will and Testament and it is my Will that it shall and may be lawful to and for my said Trustees or the Survivor of them or the Heirs of such Survivor by and out of any of the Monies which by virtue of this my Will or any Trust therein declared shall come to their or any of their hands to deduct retain to and reimburse themselves all such reasonable Costs charges and Expences as they respectively shall or may sustain expend or be put unto in and about the execution of the Trusts hereby in them reposed and that my said Trustees and their respective Heirs Executors and Administrators shall not be responsible or accountable for any more Monies than they shall respectively actually receive not the one for the other of them but each of them for his and their own Acts deeds and defaults only In Witness whereof I the said Hannah Donn the Testatrix have to this my last Will and testament contained in five Sheets of paper to each of such sheets subscribed my Name and to this fifth and last Sheet affixed my Seal this Twenty fourth day of March in the Year of our Lord One thousand eight hundred and three

This Will was proved at London on the Twenty third day of February in the Year of our Lord One thousand Eight hundred and four before the Right Honourable Sir William Wynne Knight Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the Oaths of Robert Donn and Henry Penny the Executors named in the said Will to whom Administration was granted of all and singular the Goods Chattels and Credits of the deceased they having been first sworn by Commission duly to Administer
