Four Houses and Land at Addlewell

Again, it is very difficult to ascertain exactly which parcel of land is under discussion here, since land ownership records of this period are very scarce. Below is an extract of a map, by Edward Bullock Watts, the official Town Surveyor of Yeovil, dated 1831.

 

It is thought that the triangular area of land shaded turquoise is that parcel of land sold for the erection of four houses discussed in the indenture of 6 December 1832. 

 

The indenture of 6 december 1832

 

This Indenture made the twenty sixth day of December in the year of our Lord One Thousand eight hundred and thirty two Between John Ball of Yeovil in the County of Somerset Gentleman of the first part Thomas Warr of Blandford Forum in the County of Dorset Builder of the second part and John Lawrence of Harrow on the Hill in the County of Middlesex Gentleman of the third part Whereas by a certain Indenture of Appointment bearing date the twentieth day of June last and made between Peter Daniell Esquire of the first part the said Thomas Warr of the second part and the said John Ball of the third part of the several plots pieces or parcels of ground therein and hereinafter described (and upon which four Messuages or Dwelling Houses have been lately erected by the said Thomas Warr) were directed limited appointed and assured To the Use of the said John Ball his Heirs and Assigns for ever In Trust nevertheless for the said Thomas Warr his Heirs and Assigns and to be conveyed and disposed of as he or they should direct or appoint And whereas the said John Lawrence hath contracted and agreed with the said Thomas Warr for the purchase of the fee Simple and Inheritance of and in the said several Plots of Ground and Hereditaments together with the four several newly built Messuages or Dwelling Houses lately erected thereon at or for the Price or Sum of Six hundred Pounds free from all Incumbrances Now this Indenture Witnesseth that in pursuance and execution of the said agreement and for and in consideration of the Sum of Six hundred Pounds [in excess of £70,000 at today's value] of lawful Money current in England to the said Thomas Warr in hand at or before the execution of these presents well and truly paid by the said John Lawrence the receipt whereof and that the same is in full for the absolute Purchase of the Inheritance in Fee Simple in Possession of and in the said several Plots of Ground Messuages or Dwelling Houses and Hereditaments hereinafter described and intended to be hereby Granted and Released with the Appurtenances free from incumbrances The said Thomas Warr doth hereby Admit and Acknowledge and thereof doth Quit Release and Discharge the said John Lawrence his Heirs Executors Administrators and Assigns and every of them for ever by these Presents and also in Consideration of the Sum of Five shillings of like Lawful Money as aforesaid to the said John Ball in hand at the same time paid by the said John Lawrence the receipt whereof is hereby acknowledged he the said John Ball at the request and by the direction and appointment of the said Thomas Warr (testified by his being made a party to and executing these Presents hath bargained and sold [word Illegible] and Released and by these Presents Doth Bargain Sell Alien and Release and the said Thomas Warr hath Granted Bargained and Sold and Aliened Released and Confirmed and by these Presents doth Grant Bargain Sell and the Heirs and Release and Confirm with the said John Lawrence (in his actual possession now being by Virtue of a Bargain and Sale to him thereof made by the said John Ball and Thomas Warr in Consideration of Four shillings a piece by Indenture were bearing date the day next before the day of the date of these Presents for [two words Illegible] Year to Commence from the day next before the day of the date of the same Indenture of Bargain and Sale and by Force of the Statute made for Transferring Uses into Possession) and to his Heirs and Assigns All that Plot Piece or Parcel of Ground Situate lying and being upon Addlewell within the Parish of Yeovil aforesaid Containing in Length from East to West towards the South sixty eight Feet and towards the North sixty eight Feet and in Breadth from North to South Towards the East seventy five Feet and towards the West sixty nine Feet and (be the same respectively a little more or less) Bounded on the East or North East by Premises now lately belonging to William Nossiter on the West by Premises belonging to [short space, but presumably missing 'John' - he being "Husband and Administrator of the said Mary Godsall" as described in the schedule of the June 1832 indenture] King on the North and North West by Lands of the said Peter Daniell and on the South by a new road lately built by the said Peter Daniell leading from Hendford to Back Street And also All those four several Messuages or Dwelling Houses lately erected on the said Plot of Ground by the said Thomas Warr And also All that other Plot Piece or Parcel of Ground lying opposite to and in front of the said four several Messuages or Dwelling Houses so erected and built on the said Plot of Ground hereinbefore described as aforesaid containing in length from East to West Sixty eight feet and in breadth from North to South towards the East forty four feet and towards the West forty one feet bounded on the North by the said new road on the South by Premises belonging to [space] Prowse Esquire and on the East and West by lands All which said Hereditaments and Premises are now in the possession of the said Thomas Warr or his Tenants Together with all and singular Houses Outhouses Edifices Buildings Ways Paths Waters Watercourses rights Easements Privileges Hereditaments and Appurtenances whatsoever to the said several plots of Ground Messuages or Dwelling Houses and Premises hereinbefore described and hereby granted and released or intended so to be or any part thereof belonging or in any wise appertaining And the reversion and reversions remainder and remainders yearly and other rents issues and profits thereof and of every part thereof And also all the Estate right title Interest use trust Inheritance property possession claim challenge and demand whatsoever of them the said John Ball and Thomas Warr and each of them therein and thereto To have and To hold the said several Plots Pieces or Parcels of Ground Several Messuages or Dwelling Houses and all and singular other the Premises hereinbefore described and hereby granted and released or intended so to be and every part thereof with the Appurtenances unto the said John Lawrence his Heirs and Assigns of the said John Lawrence his Heirs and Assigns for ever And the said Thomas Warr doth hereby for himself his Heirs Executors and Administrators covenant promise grant and agree to and with the said John Lawrence his heirs and assigns capitalise that in manner following (that is to say) That for and notwithstanding any act deed matter or thing whatsoever at any time heretofore made done executed or knowingly occasioned or suffered by him the said Thomas Warr to the contrary They the said John Ball and Thomas Warr are and stand or one of them is and stands lawfully rightfully and absolutely seized of the several Plots Pieces or Parcels of Ground Messuages or Dwelling Houses and Hereditaments hereinbefore described and hereby granted and released or intended so to be in of and for a good sure perfect clear absolute and indefatigable Estate of Inheritance in fee Simple in possession without the same Estate or Hereditaments being subject or liable to any qualification restriction matter or thing whatsoever which can or may revoke determine abridge qualify alter charge incumber or prejudicially affect the same in any manner howsoever And also that for and notwithstanding any act deed matter or thing as aforesaid) they the said John Ball and Thomas Warr now have or hath in themselves or himself good right full power and lawful and absolute authority to grant release and confirm the said several Plots of Ground Messuages or Dwelling Houses and Hereditaments hereinbefore described and the possession reversion and Inheritance thereof unto and to the use of the said John Lawrence his Heirs and Assigns in manner and form aforesaid and according to the true intent and meaning of these Presents And further that it shall and may be lawful to and for the said John Lawrence his Heirs and Assigns from time to time and at all times hereafter quietly and peaceably to have hold occupied possess and enjoy the said several Plots of Ground Messuages or Dwelling Houses Hereditaments and Premises hereinbefore described and hereby granted and released or intended so to be and every part thereof with the Appurtenances and to receive and take the rents issues and profits thereof to and for his and their own use and benefit without any manner of hindrance interruption disturbance denial claim or demand whatsoever of from or to the said John Ball and Thomas Warr or either of them their or either of their Heirs or any other person or persons whomsoever And that free and clear and clearly and absolutely discharged and exonerations or otherwise by and at the expense of the said Thomas Warr his Heirs Executors or Administrators saved defended kept harmless and indemnified of from and against all and all manner of former and other Estates rights titles Interests liens charges and Incumbrances whatsoever now or hereafter to be made done committed or suffered the said Thomas Warr or his Heirs or any other person claiming through or In Trust for him or them And moreover that they the said John Ball and Thomas Warr and each of them their and each of their heirs capitalise that and all and every other person or persons now or at any time hereafter rightfully claiming or possessing any Estate right title or Interest either at Law or in Equity in to or respect in the said several Plots of Ground Messuages or Dwelling Houses and Hereditaments hereby granted and released and confirmed or intended so to be or any part thereof from through under or in trust for them or him shall and will from time to time and at all times hereafter upon every reasonable request and at the costs and charges of the said John Lawrence his Heirs or Assigns make do acknowledge levied suffer and execute all and every such further and other lawful and reasonable acts deeds devices Conveyances and Assurances in the Law whatsoever for the further better more perfectly and absolutely granting releasing and assuring and confirming the same Hereditaments and Premises or any part or parcel thereof and the possession reversion and inheritance thereof with the Appurtenances unto and to the use of the said John Lawrence his Heirs and Assigns or otherwise as by him the said John Lawrence his Heirs or Assigns or his or their Counsel in the Law shall be lawfully and reasonably advised or devised and wired And the said John Ball doth hereby for himself his Heirs Executors and Administrators covenant and declare to and with the said John Lawrence his Heirs and Assigns That he the said John Ball hath not at any time heretofore done or suffered any act whatsoever whereby or by means whereof the Hereditaments and Premises hereby by him released and conveyed or any part thereof are is can or may be incumbered or prejudicially affected in any manner howsoever In witness whereof the said Parties to these Presents have hereunto set their hands and seals the day and year first above written
