1836 will of Thomas Foot

This is the last Will and Testament of me Thomas Foot of Yeovil in the County of Somerset Innholder I give and devise unto William Bidder of Yeovil aforesaid Schoolmaster all that my Messuage or dwelling house (divided into three Tenements) together with the Garden and Premises thereto adjoining and belonging situate at the bottom of Middle Street in Yeovil aforesaid and now in the possession of John Pretty and my Tenants which I lately purchased of Samuel Goldring also all other my Freehold Messuages Tenements Lands Hereditaments and Premises whatsoever and wheresoever To hold to him the said William Bidder his heirs and assigns for ever in Trust to permit and suffer my Wife Susan Foot and her Assigns to occupy and enjoy the same premises or to receive the rents issues and profits thereof for and during the term of her natural life and from and immediately after her decease in Trust to sell and dispose of the same premises either by public auction or private contract and either altogether or in separate parcels or in such other manner as he the said William Bidder his heirs or assigns shall in his or their discretion think proper and to pay and divide the money ensuing from such sale or sales unto and equally between my two sons George Foot and Charles Foot share and share alike and their respective Executors adm[inistrat]ors and assigns and for facilitating such sale or sales I do hereby direct that the receipt or receipts of the said William Bidder his heirs or assigns shall be sufficient discharge or discharges to the purchaser or purchasers of my said real estate and that suh purchaser of purchasers shall not be answerable for the application non application or misappropriation of all or any part of the purchase money for the same Also I give and bequeath the possession and use of all my household Furniture Plate Linen Chana Books pictures and other Goods and Effects of a like sort of kind which shall be in my Dwelling house at the time of my decease unto my said Wife for and during her natural life and from and immediately after her decease I give & bequeath the same unto the said William Bidder his Executors Administrators and Assigns upon Trust for and to be equally divided between my said two Sons George Foot and Charles Foot share and share alike and their respective Executors Administrators and Assigns Also I give and bequeath all my wearing apparel of every description unto my said son George Foot for his own use and benefit and as to all my live and dead Stock monies and securities for money and all the Rest Residue and Remainder of my personal estate and effects whatsoever and wheresoever the same shall be at the time of my decease I give and bequeath the same unto the said William Bidder his Executors Administrators and Assigns upon Trust to sell dispose of and convert the same respectively into money as soon as may be convenient after my decease in such manner as he or they shall think proper and stand possessed of the money arising therefrom in Trust in the first place [thereout ?] to pay and discharge all my just debts and funeral and Testamentary expences and after payment and discharge thereof upon Trust to place out and invest the residue of the said money on such security or securities and vary the same from time to time as he the said William Bidder his Executors Adm[inistrat]ors or Assigns shall think proper and pay the interest dividends and proceeds thereof to my said Wife for and during the term of her natural life and from and immediately after her decease upon Trust to pay and divide such residue and the Funds and securities upon which the same may be then invested unto and equally between my said two Sons George Foot and Charles Foot share and share alike and their respective Executors Administrators and Assigns And I do hereby direct that it shall be lawful for the aid William Bidder his heirs Executors and Administrators by and out of the monies which shall come to his or their hands by virtue of this my Will to reimburse himself and themselves such costs charges and expences as he or they shall sustain or be put unto in or about the execution of the Trusts hereby in him and them reposed and that the said William Bidder his heirs Executors or Administrators shall not be chargeable for more monies than shall actually come to his or their hands by virtue of this my Will nor with or for any loss or damage which may happen to the same without his or their gross and wilful default And lastly I do hereby nominate and appoint the said William Bidder sole Executor in Trust of this my last Will and Testament In Witness whereof I the said Thomas Foot the Testator have to each sheet of this my last Will and Testament contained in three sheets of paper set my hand and to this last sheet my Seal also this eighth day of October One thousand eight hundred and thirty six

Proved at London 22nd February 1837 before the Judge by the Oath of William Bidder the sole Executor to whom Administration was granted having been first sworn by Commission duly to Administer
