1839 will of Ann Taylor

Widow of Robert Taylor

 

This is the last Will and Testament of me Ann Taylor of Yeovil in the County of Somerset Widow whereas my late husband Robert Taylor of Yeovil aforesaid Chair and Basket Maker in and by his last will and testament bearing date on or about thew twenty first day of April one thousand eight hundred and twenty eight did direct that a Benjamin Swaffield the younger and Thomas Samways (the trustees and executors therein named) should immediately after my death pay over one moiety or equal half part of the produce of his dwellinghouse household goods and furniture monies and effects therein mentioned to such person or persons and in such parts shares and proportions as I the said Ann Taylor should by any deed or writing or by my last will and testament direct of appoint give or devise the same Now I do by this my last will and testament in execution of the power vested in me as hereinbefore is mentioned and of all other powers me thereunto enabling direct and appoint and as far as in me lies give devise and bequeath that All that the said moiety or equal half part of the produce of the said estate and effects of my said late husband the said Robert Taylor deceased shall immediately after my death be paid over or belong to the several persons hereinafter named, that is to say, I give direct and appoint one equal seventh part or share thereof unto my son Thomas Swaffield his executors administrators and assigns, one other equal seventh part or share thereof unto my son Bennett Mintern Swaffield his executors administrators and assigns, one other equal seventh part or share thereof unto my daughter Harriett Oliver her executors administrators and assigns, one other equal seventh part or share thereof unto my daughter Ann Stainer her executors administrators and assigns. As to one other equal seventh part or share thereof , I give direct and appoint one moiety or equal half part or share thereof unto my granddaughter Harriett Adams, one of the daughters of my late son John Swaffield her executors administrators and assigns and the other equal moiety of half part of such last mentioned equal seventh part unto my granddaughter Anne Swaffield the other daughter of my late son John Swaffield (in case she shall live to attain the age of twenty one years) her executors administrators and assigns But if my said granddaughter Anne shall die under the age of twenty one years and unmarried then I direct that the part or share hereinbefore given and appointed unto her shall go and be paid to my said granddaughter Harriett her executors administrators and assigns And as to the remaining one seventh part or share I give direct and appoint the same unto Robert Stacey of Yeovil aforesaid Cordwainer and George Brown of the same place Tailor as trustees and executors under the last will of my son Robert Swaffield now lately deceased to be held and disposed of by them the said Robert Stacey and George Brown or other the trustees or trustee under the will of my said son Robert Swaffield upon such and the same trusts and with under and subject to such and the same powers and provisions in all respects as are in such will expressed and contained of and concerning the general real and personal estate of the said Robert Swaffield And I direct and appoint that the receipt or receipts of the said Robert Stacey and George Brown or other the executors or executor of the said Robert Swaffield shall be a good and sufficient discharge unto the said Benjamin Swaffield the younger and Thomas Samways or other the trustees or trustee acting under the will of my said late husband for such last mentioned one seventh part or share of the moiety of the produce of his estate and effects I give and bequeath all my wearing apparel unto my said two daughters Harriett Oliver and Ann Stainer to be equally divided between them And as to all other my own proper real and Personal Estate and Effects I give devise and bequeath the same unto my said son George Swaffield his heirs administrators and assigns upon trust by such ways and means as he or they shall seem fit to sell and convert into money such part thereof as shall be in it nature saleable and to stand possessed of the produce thereof together with such part of my personal estate as shall consist of money upon trust (after paying thereout all my just debts funeral and testamentary expences and the expences of proving and carrying into execution the trusts of this my will; to divide the same into seven equal parts or shares and to pat the same several shares respectively unto such and the same persons and in the same manner as I have hereinbefore directed respecting the seven several shares of the moiety subject to my appointment under the will of my said husband deceased And I declare that the receipt or receipts of the said George Swaffield or of his executors administrators and assigns for any money payable to him or them by virtue of this my will shall be a good discharge for the same and shall exonerate the person or persons paying the same from all responsibility of seeing to the application thereof And I hereby further declare my mind and will to be that (except as I have hereinbefore mentioned) in case of the death of any or either of my said children in my lifetime the part or share hereinbefore given appointed devised or bequeathed for his her or their benefit shall go belong and be paid to the personal representatives of him her or them so dying in my lifetime as aforesaid And I appoint my said son George Swaffield sole Executor in trust of this my will and hereby revoke my all other wills by me at any time heretofore made I declare this to be my last will and testament In testimony whereof I have to this my last will and testament set my hand and seal this thirtieth day of August in the year of our Lord one thousand eight hundred and thirty nine

This is a Codicil to the last will and testament of me Ann Taylor of Yeovil in the County of Somerset bearing date on or about thirtieth day of August one thousand eight hundred and thirty nine and which I desire may be considered as annexed thereto and be taken as part thereof Whereas I have in and by my said will given and appointed unto my granddaughter Harriet the wife of William Adams a certain share of and in the produce or proceeds arising from the sale of certain real and personal property therein mentioned and over which I have a disposing power under and by virtue of a power contained in my late husband's will Now it is my will and I do hereby direct and appoint that the part or share so given by my said will to my said granddaughter Harriet Adams shall be for her own sole and separate use and be in nowise subject or [irable ?] to the debts controul or management of her said husband and that her receipt alone notwithstanding her coverture shall be a sufficient discharge to my said executor for the same In witness whereof I the said Ann Taylor have to this codicil to my last will and testament set my hand the thirty first day of October one thousand eight hundred and forty two

Proved at London with a codicil 26th March 1844 before the Judge by the Oath of George Swaffield the son the sole Executor to whom Administration was granted having been first sworn by commission duly to administer
