1853 Will of Elizabeth Budge
Widow
This is the last Will and Testament
of me Elizabeth Budge
of Yeovil in the
County of
Somerset Widow
which I make for
the disposal of
all my worldly
estate and
effects in
manner and form
following that
is to say I
desire to be
buried in a
decent and
respectable
manner at the
discretion of my
executors
hereinafter
named
All my
monies and
securities for
money goods
chattels rights
credits
Estate and
Effects
whatsoever and wheresoever charged and chargeable with the
payment of my
just debts
funeral expences
and the costs of
proving this my
Will
I give
and bequeath
unto Robert
Perry of
Crewkerne in the
County of
Somerset
Accountant and
John Budge of
the same place
Grocer their
heirs executors
administrators
and assigns all
my estate and
interest therein
respectively
upon the trusts
following that
is to say upon
trust that they
the said Robert
Perry and John
Budge and the
survivor of them
and the
executors and
administrators
of such survivor
do and shall as
soon as
conveniently may
be after my
decease convert
the whole of my
said estate and
effects into
money and divide
the same into
five equal parts
or shares and
pay one fifth
part thereof
unto my son
George Payne
Budge his
executors and
administrators
one other fifth
part unto my son
Thomas Budge his
executors and
administrators
one other fifth
part unto my
daughter Mary
Aplin her
executors and
administrators
and the
remaining one
fifth part
thereof unto the
three children
of my late son
Edward Budge
their executors
and
administrators
the same to be
equally divided
between them
share and share
alike as tenants
in common and
not as joint
tenants And I do
hereby direct
that the receipt
or receipts in
writing of the
said Robert
Perry and John
Budge and the
survivor of them
his heirs
executors and
administrators
shall be a good
valid and
effectual
discharge and
discharges both
at law and in
equity to any
person or
persons paying
any monies to
them and that
such purchaser
or purchasers
his her or their
heirs executors
administrators
or assigns shall
not be obliged
to look to the
application of
such purchase
money or be
prejudiced or
injured by the
misapplication
or
nonapplication
thereof and I do
hereby declare
that the said
Robert Perry and
John Budge or
either of them
their or either
of their
executors or
administrators
shall not be
charged or
chargeable with
or for any trust
monies than they
respectively
shall actually
receive by
virtue of this
my Will nor with
or for any loss
which may happen
to the said
trust monies or
estate unless
the same happen
through their
wilful default
And also that
the said Robert
Perry and John
Budge lawfully
may by and out
of the said
trust monies and
estate deduct
retain to and
reimburse
himself and
themselves
respectively and
pay to his
co-trustee all
costs charges
payments and
expences which
he or they
respectively
shall be at or
put unto in the
execution of
this my Will or
any of the
trusts relating
thereto And I do
hereby make
nominate
constitute and
appoint the said
Robert Perry and
John Budge
joint
Executors In trust of this my last Will
and Testament
and do hereby
revoke all
former and other
Wills by me at
any time
heretofore made
and declare this
only to be my
last Will and
testament In
Witness whereof
I the said
Elizabeth Budge
the testatrix
have to this my
last Will and
Testament
contained in two
sheets of paper
subscribed my
name this twenty
third day of
March one
thousand eight
hundred and
fifty three
