1879 Marriage Settlement

Between George Kellaway and Sarah Ann Collings

 

The marriage settlement between retired glover George Kellaway and Sarah Ann Collings was written in 1879 when George was aged 67 and Sarah was aged 52. They only make one appearance as a couple - in the census return of 1881, at which time they were living at 119 Park Street - one of the three houses in the marriage settlement perhaps?

 George died in Yeovil in 1885, aged 78. Sarah died in Yeovil in 1897, aged 70.

This Indenture made the First day of August One thousand eight hundred and seventy nine Between George Kellaway of Yeovil in the County of Somerset a retired Glover of the first part Sarah Ann Collings of Yeovil aforesaid Spinster of the second part and William Cox and Joseph Chaffey Moore both of Yeovil aforesaid Gentleman of the third part Whereas a Marriage is intended to be solemnized between the said George Kellaway and Sarah Ann Collings And whereas the said Sarah Ann Collings Is Seized in Fee Simple of the Dwellinghouses Gardens and premises hereinafter described and upon the treaty for the said intended Marriage it was agreed that the same Dwellinghouses Gardens and premises should be conveyed unto the said William Cox and Joseph Chaffey Moore their heirs and assigns to the uses and upon the trusts intents and purposes hereinafter declared concerning the same Now this Indenture Witnesseth that in consideration of the said intended Marriage and also in consideration of Five shillings now paid by the said William Cox and Joseph Chaffey Moore to the said Sarah Ann Collings (the receipt whereof is hereby acknowledged) of the said Sarah Ann Collings [word illegible] approbation of the said George Kellaway (testified by his executing these presents) doth hereby grant and convey unto the said William Cox and Joseph Chaffey Moore and their heirs All that Messuage or Dwellinghouse erected or built on a piece or parcel of Land taken out of an Orchard called Pen (?) Orchard situate in Hendford in Yeovil aforesaid with the Garden thereto adjoining bounded on the East by the Road called Park Street and on the West and North by Lands some time since belonging to Peter Daniell Esquire deceased and which said Dwellinghouse is now divided into Three Tenements and in the respective occupations of the said George Kellaway and others Together with all buildings lights ways passages waters watercourses liberties easements rights members and appurtenances whatsoever to the said Tenements Gardens and premises belonging or in anywise appertaining or with the same or any part thereof used and enjoyed as appurtenant thereto And all the estate right title interest claim and demand whatsoever of her the said Sarah Ann Collings in to and upon the same premises To have and To hold the said premises hereinbefore expressed to be hereby granted (Subject to the Right of Way delineated and described in the Plan drawn in the margin of a certain Indenture dated the Nineteenth day of June One thousand eight hundred and seventy eight and made between the said George Kellaway of the one part and Edward Guppy of the other part and therein coloured Pink through the passage of one of the Dwelling Houses of the said Edward Guppy) unto the said William Cox and Joseph Chaffey Moore and their heirs in trust that they the said William Cox and Joseph Chaffey Moore and the Survivor of them and the heirs of such Survivor do and shall from time to time during the life of the said Sarah Ann Collings pay the clear yearly rents and profits thereof unto or permit the same to be received by the said Sarah Ann Collings for her sole and separate use and benefit and to the intent that the same may not be at the disposal of or subject or liable to the control of the said George Kellaway her intended Husband And from and after the decease of the said Sarah Ann Collings Upon trust that they the said William Cox and Joseph Chaffey Moore and the Survivor of them and the heirs of such Survivor do and shall from time to time during the life of the said George Kellaway pay the clear yearly rents and profits thereof unto or permits the same to be received by the said George Kellaway for his benefit And after the death of the Survivor of them the said George Kellaway and Sarah Ann Collings In trust for such person or persons and in such shares and proportions as the said Sarah Ann Collings shall by any Deed or Will direct or appoint give or devise the same And the said Sarah Ann Collings doth hereby declare that the same hereditaments and premises shall at all times hereafter remain continue and be to for and upon the several uses trusts intents and purposes and with under and subject to the several powers provisos declarations and agreements hereinbefore expressed and declared and contained of or concerning the same and shall and may be peaceably and quietly held and enjoyed and the rents and profits thereof received and taken accordingly without any denial interruption disturbance from the said Sarah and Collings or her and their heirs or any other person or persons lawfully or equitably claiming so to claim under or in trust for her or them In Witness whereof the said parties to these presents have hereunto set their hands and seals the day and year first above written

Memorandum that by an Indenture dated the Tenth day of May One thousand eight hundred and ninety seven and made between William Cox Joseph Chaffey Moore and Benjamin Collings of the first part James McMillan of the second part and Sydney William Tavener of the third part A Cottage and Garden No 14 Park Street Yeovil will part of the within mentioned hereditaments now in the occupation of George White were conveyed unto and to the use of the said Sydney William Tavener in fee simple and the right of the said Sydney William Tavener to production of the within written Indenture was duly acknowledged
