1912 Indenture

Sale of Shen's Higher Ryalls and Shen's Lower Ryalls

This indenture made the tenth day of April one thousand nine hundred and twelve Between Henry Herbert Worsfold Mayo of North Coker in the parish of East Coker in the County of Somerset Gentleman and Frank Whitmash Mayo of Swallowcliff Yeovilton in the same County Gentleman (hereinafter called the Vendors) of the one part and The Mayor Aldermen and Burgesses of the Borough of Yeovil aforesaid (hereinafter called the Corporation) of the other part Whereas the Vendors are seized as tenants in common in equal shares of the hereditaments hereinafter described and intended to be hereby conveyed for an estate of inheritance in fee simple in possession free from incumbrances And whereas the Vendors have agreed to sell the said Hereditaments  to the Corporation at the price of Three thousand five hundred pounds [two lines illegible] by the Corporation (the receipt whereof the Vendors hereby acknowledge) each of them the vendors so far as related to his own share estate or interest in the Hereditaments hereby assured and as Beneficial Owner thereof hereby conveys unto the Corporation All those two closes of arable land situate in the parish of Yeovil aforesaid and called Ryalls containing by estimation Fourteen acres (more or less) one of which said closes is on the Tithe Apportionment for Yeovil aforesaid called Shen's Lower Ryalls and containing Nine acres and twenty perches (more or less) and in the Map annexed to the said Apportionment No 530 and the other of the said closes his in the said Apportionment called Shen's Higher Ryalls and contains Four acres and ten perches (more or less) and in the said Map is No993 and which the said closes or parcels of land are more specifically described in the Schedule hereunder written and are shown on the plan annexed hereto and thereon coloured pink To hold unto the Corporation in fee simple and the Vendors hereby acknowledge the right of the Corporation to the production of an Indenture of Conveyance dated the nineteenth day of March One thousand eight hundred and fifty and made between the venerable and Rev William Thomas Parr Brymer of the first part Henry Bryant Phelps of the second part and Thomas Lyon of the third part and to another Indenture of Conveyance dated the seventh day of April One thousand nine hundred and two made between Thomas Worsfold Mayo of the one part and the Vendors of the other part and to the delivery of copies thereof respectively and hereby [word illegible] for the safe custody thereof And of the Vendors do and each of them doth hereby covenant with the Corporation that when and as soon as all the Hereditaments  comprised in and to which the said Indenture of the nineteenth day of March One thousand eight hundred and fifty relates have been sold they their executors administrators or assigns will deliver to the Corporation the same Indenture together with certain earlier title deeds relating to the Hereditaments  hereinbefore conveyed and to other Hereditaments  In witness whereof the vendors have hereunto set their hands and seals and the Corporation have caused their Common Seal to be hereto affixed the day and year first above written
