The 1778 Will of Samuel Dampier, Gentleman

 

By this my Last Will and Testament made the second day of November in the Year of our Lord one thousand seven hundred and seventy eight I Samuel Dampier of Yeovil in the County of Somerset Gentleman do give devise and bequeath all and singular my real and personal estate whatsoever and wheresoever the same do lie unto my Sister Sarah Macbraire In Trust for her Daughter Elizabeth Macbraire and to by her managed until her said Daughter shall attain her age of twenty one years and from and after her attainment to that age then I give devise and bequeath all and singular the said real and personal Estate unto her the said Elizabeth Macbraire to hold to her and to her Heirs Executors Administrators and Assigns respectively But in case the said Elizabeth Macbraire shall happen to die before her attainment to the age of twenty one years then and in such case I do hereby give devise and bequeath all and singular the said real and personal Estate unto my said Sister Sarah Macbraire to and for her own use and to be disposed of as she shall think proper and I do hereby make constitute and appoint my said Sister whole and sole Executrix of this my last Will and Testament In Trust and for the purposes afores[ai]d hereby revoking all former and other Wills by me at any time heretofore made In writing whereof I the said Samuel Dampier the Testator have hereunto set my Hand and Seal the day and year first above written

Signed Sealed Published and Declared by the said Testator as and for his last Will and Testament in the presence of us who at his request and in his presence have set our Names as Witnesses thereto

This Will was proved at London the sixth day of July in the Year of our Lord one thousand seven hundred and seventy nine before the Right Worshipful Peter Calvert Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the oath of Sarah Macbraire Widow the Sister of the Deceased and the Executrix In Trust until her Daughter Elizabeth Macbraire Spinster shall attain her age of twenty one years to whom Administration was granted of all and singular the Goods Chattels and of the said Deceased having been first sworn by Commission duly to administer
