Indenture (re-conveyance)

Between Henning and Sully to Blake

 

Although not specifically mentioned, this indenture, a re-conveyance, almost certainly relates to the Duke of Clarence in Stars Lane since, apart from a row of small cottages, it was the only property in Stars Lane at the time. The brewer Edmund Charles Henning was probably the grandson of the brewer Edmund Henning of Yeovil Old Brewery.

This Indenture made the thirtieth day of November one thousand eight hundred and ninety four Between Edmund Charles Henning formerly of the Bow Brewery in the City of London but now of the Anchor Brewery in the City of Dublin Brewer and John Blake Sully formerly of Yeovil in the County of Somerset but now of Saint Michael's House, Cornhill in the City of London Gentleman of the one part and Samuel Hitchcock of Yeovil aforesaid Glove Manufacturer of the other part and supplemental to the following deeds namely :- (1) An Indenture (hereinafter called "the Principal Indenture") dated the thirteenth day of November one thousand eight hundred and eighty five and made between the said Samuel Hitchcock of the one part and Thomas Smith and William Neale of the other part being a Mortgage of a certain messuage or dwellinghouse garden and premises situate in Stars Lane in Yeovil aforesaid for securing payment by the said Samuel Hitchcock to the said Thomas Smith and William Neale of the sum of one hundred and eighty pounds with interest thereon and (2) An Indenture (endorsed in the Principal Indenture) dated the twelfth day of December one thousand eight hundred and eighty eight and made between the said Thomas Smith Edmund Charles Henning and John Blake Sully. Whereas the said Thomas Smith died on the twenty third day of September one thousand eight hundred and ninety four And whereas all principal moneys and interest secured by the Principal Indenture has been paid and satisfied before the execution of these presents as the said Edmund Charles Henning and John Blake Sully hereby acknowledge Now this Indenture witnesseth that in consideration (three words illegible) the said Edmund Charles Henning and John Blake Sully as Mortgagees hereby convey unto the said Samuel Hitchcock All that the messuage or dwellinghouse garden and premises comprised in the Principal Indenture To hold the same now and to the use of the said Samuel Hitchcock in fee simple absolutely discharged from all principal moneys and interest secured by and all claims and demands under the Principal Indenture. In witness whereof the said parties to these presents hath hereunto set their hands and seals the day and year first before written
