1836 Lease of LaND

The 1836 lease of a plot of land in St Peter's Street

 

This is a lease in the Heritage Centre, Taunton, dated 7 June 1836 and made between James Edwards and John Cox with William baker for a plot of land at St Peter's Street (now Peter Street).



This Indenture made the seventh day of November in the year of our Lord one Thousand eight hundred and thirty six Between James Edwards the younger of Yeovil in the County of Somerset Draper and John Cox of the same place Carpenter of the one part and William Baker of Yeovil aforesaid Yeoman of the other part Witnesseth that for and in consideration of the sum of five shillings of lawful English Money to each of them the said James Edwards and John Cox at or before the sealing and delivery of these presents paid by the said William Baker the receipts whereof respectively are hereby acknowledged They the said James Edwards and John Cox have and each of them hath bargained and sold and by these presents do and each of them doth bargain and sell unto the said William Baker his executors administrators and assigns All that Plot piece or parcel of Ground (being part of a back Lawn granted and released unto the said James Edwards and John Cox by Indentures of Lease and of Release and Assignment bearing date respectively the twenty ninth and thirtieth days of April last, the release & assignment made between Thomas Brickenden, Doctor of Physic, and William Good, Plumber, of the first part, the Reverend Henry Peter Daniell, Clerk, of the second part, the Reverend Edward Hansford Daniell, Clerk, and Mary his Wife of the third part, Edwin Newman and Henry Marsh Watts, Gentlemen of the fourth part, the said James Edwards of the fifth part and the said John Cox of the sixth part) situate lying and being in Saint Peter's Street in Yeovil aforesaid containing in length from North to South towards the East sixty two feet and towards the West sixty feet, and in  breadth from East to West eighteen feet (be the same respectively a little more or less) bounded on or towards the north by premises ^ belonging to Thomas Symonds, on or towards the South by a New Road or Street lately laid out and made by the said James Edwards and John Cox called Saint Peter's Street, leading from Wine Street to Bond Street, on or towards the East by another Plot of Ground (also part of the said back Lawn) lately purchased of the said James Edwards and John Cox by (blank) Knobbs and upon which he is now erecting a Dwellinghouse and on or towards the West by another Plot of Ground (also part of the said back Lawn) lately purchased of the said James Edwards and John Cox by Joseph Staple and upon which he is also now erecting a dwellinghouse Together with the said Dwellinghouse no erecting by the said William Baker on the said Plot of Ground hereby bargained and sold or intended so to be And also full and free liberty and right of Ingress Egress and Regress Passage and Way, to and for the said William Baker his appointees heirs and assigns and his and their Tenants Servants Workmen and others either with or without horses Carts and Carriages at all times hereafter unto and from the said Plot of Ground hereditaments and premises hereby bargained and sold or intended so to be  and every or any part thereof in through over and upon the said new Road or Street called Saint Peter's Street and also in through over and upon another Road or Street also lately laid out and made by the said James Edwards and John Cox called Union Street leading from Wine Street to Middle Street And also all other houses Outhouses Buildings ways paths passages waters watercourses easements profits advantages hereditaments and appurtenances whatsoever to the said Plot of Ground hereditaments and premises hereby bargained and sold or intended so to be or to any part thereof belonging or in anywise appertaining And the reversion and reversions remainder and remainders yearly and other rents issues and profits thereof To have and to hold the said Plot piece or parcel of Ground and all and singular other the hereditaments and premises hereinbefore described and hereby bargained and sold or intended so to be with the appurtenances unto the said William Baker his executors administrators and assigns from the day next before the day of the date of these presents for and during and unto the full end and term of one year from thence next ensuing and fully to be complete and ended yielding and paying therefore unto them the said James Edwards and John Cox their heirs and assigns the rent of a pepper corn on the last day of the said Term (if the same shall be lawfully demanded) To the intent and purpose that the virtue of these presents and by force of the Statute of Uses the said William Baker may be put into and be in the full and actual possession of all and singular the said plot piece or parcel of Ground hereditaments and premises hereby bargained and sold or intended so to be and be thereby enabled to accept and take a release and Conveyance of the reversion and inheritance thereof to him the said William Baker and his heirs To such uses upon such Trusts and for such intents and purposes as are mentioned expressed and declared of and concerning the same in and by a certain Indenture of Appointment and Release already prepared and intended to bear date the day next after the day of the date of these presents and made or expressed to be made between the said James Edwards of the first part, the said John Cox of the second part, the said William Baker of the third part and John Ball of Yeovil aforesaid Writer of the fourth part In witness whereof the said parties to these presents have hereunto set their hands and seals the day and year first above written.
