1812 Lease - Chequers/1&3 Princes St

The 1812 lease of the Chequers alehouse and 1&3 Princes Street

 

This is a lease, dated 12 July 1812 for the Chequers alehouse in Huish and the property today known as 1&3 Princes Street ("the Messuage or Tenement and Dwellinghouse situate near the Angel Inn"), made between the three brothers Joseph Watts, Samuel Watts the Younger and Edward Watts of the fist part and Thomas Bullock and James Glyde of the second part. It should be noted that Thomas Bullock was the Watts brothers' uncle and James Glyde had married their sister Mary.



To all to whom these presents shall come We Thomas Bullock of Yeovil in the County of Somerset Gentleman and James Glyde of Yeovil Marsh within the parish of Yeovil aforesaid Gentleman send Greeting Whereas in and by certain Indentures of Lease and Release with assignment bearing date respectively the eleventh and twelfth days of July Instant the Release and assignment being of four parts and made or mentioned to be made between Joseph Watts of Yeovil aforesaid Gentleman of the first part Samuel Watts the younger of the same place Gentleman of the second part Edward Watts also of the same place Landsurveyor of the third part and us the said Thomas Bullock and James Glyde of the fourth part After reciting that the said Samuel Watts and Joseph Watts in trust for him were or one of them was seized in Fee & well entitled unto the Messuage or Tenement and Dwellinghouse situate near the Angel Inn in Yeovil aforesaid therein and hereinafter particularly mentioned and described And further reciting that the said Joseph Watts & Samuel Watts In Trust for him were or one of them was seized in Fee & well entitled unto the other Messuage or Dwellinghouse Garden & premises therein and hereinafter described formerly called the Chequers Inn situate in Yeovil aforesaid And also that the said Joseph Watts & Edward Watts In Trust for him were or one of them was seized in Fee & well entitled unto the Garden plott & premises therein & hereinafter described adjoining the last mentioned Messuage And also reciting that the said Samuel Watts was possessed of or well entitled unto the Garden plott adjoining the first mentioned Dwellinghouse thereinafter mentioned for the remainder of a certain term of two thousand years And further reciting that the said Samuel Watts had then some time since promised and agreed to sell & convey the last mentioned Garden plott and first mentioned Messuage & premises adjoining unto him the said Joseph Watts who was then in the possession thereof and had made certain improvements thereon but no Money had been paid or any contract or conveyance then been made And also reciting that the said Samuel Watts and Joseph Watts for & in consideration of the sum of one thousand nine hundred & fifty pounds had agreed to sell convey & assure all their Estates rights and Interests in all the above mentioned Messuages Gardens plotts & premises & that the said Edward Watts should convey his trust Estate therein unto us the said Thomas Bullock and James Glyde in manner as hereinafter mentioned It es(?) in the first place Witnessed that in pursuance & performance of the said Agreements & in consideration of the said sum of one thousand nine hundred and fifty pounds therein stated to be paid by us the said Thomas Bullock & James Glyde to the said Samuel Watts and Joseph Watts and for other the considerations therein mentioned They the said Samuel Watts Joseph Watts and Edward Watts did and each of them did (according to their respective Estates rights and interests in the premises respectively) grant bargain sell alien release ratify and confirm unto us the said Thomas Bullock and James Glyde (in our actual possession as therein mentioned) our Heirs and assigns All that the aforesaid first mentioned Messuage or Tenement and Dwellinghouse situate standing & being in Yeovil aforesaid near the Angel Inn there which said premises were formerly in the possession of John Rooks sadler deceased afterwards of Elizabeth Rooks deceased Widow and Relict of the said John Rooks and John Rooks Clerk (Eldest son & heir at law of the said John Rooks deceased) or one of them since of Thomas Rooks sadler another son of the said John Rooks deceased then of Samuel Tomes late of Samuel Watts the Elder since of Samuel Watts (party there to) but then of him the said Joseph Watts together with all buildings Outhouses and erections thereon lately built by the said Joseph Watts as aforesaid And also all that the aforesaid second refered to Messuage Tenement or Dwellinghouse formerly a Barn Flax Shop & Drying House but long since converted into a public House called or known by the name or sign of the Chequers situate standing or being within the parish of Yeovil aforesaid in the road or way leading into Hewishe Field & also the Backside & such part of the Garden as was then divided or allotted to the said Messuage or Dwellinghouse thereunto adjoining and belonging all which said premises were heretofore in the tenure or possession of one Henry Wills deceased afterwards of one William Anstice and Joseph Anstice afterwards of George Fownes(?) and Sarah Bicknell deceased since that of John Bicknell also deceased late of William Hull but then of him the said Joseph Watts his Tenant or Tenants And also all that the aforesaid Garden Plott or enclosed piece of Ground (thirdly above refered to) containing by estimation Eighty feet in length and forty six feet in breadth situate lying and being next adjoining to the last mentioned Messuage or Dwellinghouse called the Chequers which said Garden plott is bounded on the east by the said last mentioned Messuage and Garden on the South by the said road on the North by the Lands of John Goodford Esquire & on the West by the dissenters Burying Ground & was with the said last mentioned Messuage and other premises heretofore in the possession of the said Henry Wills deceased but then of him the said Joseph Watts his Tenant or Tenants To hold the same with the Appurt[enance]s unto and to use of us the said Thomas Bullock & James Glyde our Heirs & Assigns for ever And then the said Indenture further Witnessed that for the consideration aforesaid They the said Samuel Watts and Joseph Watts (according to their several and respective Estates & Interests of & in the said Garden plott & premises) Did and each of them Did grant bargain sell assign transfer set over ratify and confirm unto us the said Thomas Bullock and James Glyde our Executors Adm[inistr]ors & Assigns All that the aforesaid last recited Garden or Plott of Ground at the Higher end of and above a large Pear Tree which some time since grew in the aforesaid Garden belonging to the first mentioned Dwellinghouse & formerly enclosed but then thrown into one with the rights members and Appurt[enance]s thereunto belonging and appertaining which said Garden or Plott of Ground was then in the possession of the said Joseph Watts To hold the same with their Appurt[enance]s unto us the said Thomas Bullock & James Glyde our Ex[ecut]ors Adm[inistrat]ors and Assigns from the day of the date thereof for & during all the rest residue & remainder of a certain term of Two thousand years which commenced on or about the twelfth day of August in the fifteenth year of King Charles the second as in and by the said in part recited or refered to Indentures on a reference being thereunto respectively had will more fully & at large appear And Whereas the said consideration Money or sum of one thousand nine hundred & fifty pounds expressed to be paid by us the said Thomas Bullock and James Glyde to the said Samuel Watts & Joseph Watts was the proper Money of him the said Samuel Watts the younger alone and our Names in such conveyance were only used in trust for the said Samuel Watts Now therefore know ye that we the said Thomas Bullock and James Glyde do hereby acknowledge testify & declare that the said sum of One thousand nine hundred & Fifty pounds above mentioned to be paid by us the said Thomas Bullock and James Glyde for the purchase of the said Messuages Heredi[tamen]ts and premises as aforesaid was the proper money of the said Samuel Watts and that the names of us the said Thomas Bullock and James Glyde in the said recited Indentures were only used as respects both the said Freehold & Leasehold premises thereby conveyed [end insertion] In Trust for him the said Samuel Watts his Heirs Ex[ecut]ors Adm[inistrat]ors & Assigns respectively and that we our Heirs Ex[ecut]ors Adm[inistrat]ors and Assigns respectively shall& will at any time or times hereafter upon the request and at the proper costs and charges of the said Samuel Watts his Heirs Ex[ecut]ors Adm[inistrat]ors or Assigns transfer convey assign and assure unto the said Samuel Watts his Heirs Ex[ecut]ors Adm[inistrat]ors & Assigns respectively or to such person or persons as he or they shall direct or appoint all and singular the said Messuages Heredi[tamen]ts and premises both freehold & leasehold with their respective rights Members & Appurt[enance]s mentioned & comprised in the above in part recited Indentures so conveyed and assigned unto us the said Thomas Bullock and James Glyde our Heirs Ex[ecut]ors Administrators and Assigns respectively and all our respective Estate and Interest therein and thereto be the same by Fine or Fines Common recovery or common recoveries Deed inrolled or not inrolled or any other matter of record or otherwise howsoever as by the said Samuel Watts his Heirs Executors Administrators or Assigns respectively or his or their or either of their Counsel named in the law shall be reasonably devised or advised and required In Witness whereof we the said Thomas Bullock and James Glyde have hereunto set our hands and Seals the thirteenth day of July in the Fifty second year of the Reign of our Sovereign Lord George the Third by the Grace of God of the United Kingdom of Great Britain and Ireland King Defender of the Faith and in the year of our Lord one thousand Eight hundred & twelve
