1715 will of Jeremiah Hayne

In the name of God Amen I Jeremiah Hayne of Yeovill in the County of Som[er]sett Linnen Draper being of sound mind and understanding this Twenty third day of July in the first yeare of King George and in the yeare of Our Lord 1715 do make and declare this to be my last Will and Testament in manner and forme following First I recommend my Soul into the hands of Almighty God and my body I desire may have decent and Christian buriall and Whereas I have by one or more Deed or Deeds granted and conveyed unto Samuell Daniell the Younger and Paul Jennis both of Yeovill aforesaid Mercers and to their Heires and Assignes for ever All that my Tenement late in the tenure of John Hayne dece[ase]d and now in my possession Scituate in Kingston juxta Yeovill within the said Parish of Yeovill an the said County of Som[er]sett and also all those my Two Closes of Meadow and Pasture Ground formerly four Closes lyeing at Brightmore Hill in Kingston juxta Yeovill aforesaid within the said Parish of Yeovill containing by Estimation Nine Acres and also all that Close of Meadow and pasture ground lyeing at Milford containing by estimation five Acres and also one acre of arable Land in Penn feild and also all that Close of Arrable Land lyeing at or neare a place called St Thomas Cross containing two Acres and three severall acres lyeing in the middle Field of Kingston juxta Yeovill aforesaid all which Lands and Premises are Scituate lyeing and being in Kingston juxta Yeovill aforesaid within the said Parish of Yeovill aforesaid To hold to the said Samuell Daniell and Paul Jennis their Heirs and assignes for ever subject and under a power for me to revoke the same My Will now is and I do hereby ratify and confirm the said Deed or Deeds and do hereby give and Devise the aforesaid Tenement Lands and all other the said Premises with their Appurtenances unto my Son Jeremiah Hayne his Heires and Assignes for ever all that Messuage Tenement Garden Orchard and backside with all its rights Members Appurten[anc]es within the said Parish of Yeovill which I lately purchased of George Cary and also all that parcell of Land lying in Gold Craft which I lately purchased of Henry Dampier containing One Acre and halfe To hold the said Messuage and Acre and halfe of Land and Premises with thier Appurten[anc]es unto my said Son Jeremiah Hayne his Heires and Assignes for ever, also I give unto my said Sonne Jeremiah my best Feather bed and the Bedstead Curtains and Vallons Quilt my best bolster my two best pillows my two best pillowties my best pair of blanketts two pair of my best Sheets with all other Appurten[anc]es to my best Bed belonging, also I give unto my Son in Law Samuell Daniell the Summe of One Hundred pounds of Lawfull money to be paid unto him within one yeare after my Decease upon Trust nevertheless to and for the Sole and only use and benefitt of Mary Daniell Daughter of the said Samuell Daniell to be paid unto her when she shall marry or accomplish her age of One and Twenty yeares which shall first happen and my Desire is that the said One hundred pounds may be placed out at Interest for her use and benefit, my Will further is that if the said Mary Daniell shall happen to dye before the time appointed for payment then and in such case I do give and declare the said One Hundred pounds and all the Interest that shall be raised unto and to the use of Elizabeth Daniell my Grand Daughter to be paid unto her when She shall attaine her age of Twenty One yeares or day of marriage which shall first happen and if the said Elizabeth shall happen to dye before the time of payment then I do give the one Hundred pounds and the Interest thereof unto and amongst all and every of my Daughter Daniells Children by her now husband which shall be then liveing equally to be divided amongst them to be paid as they shall attaine their respective Ages of Twenty one yeares or on their respective days of Marriage which shall first happen, Also I give unto my Son in Law Samuell Daniell the Summe of Fifty pounds of Lawfull money to be paid unto him within Twelve months after my decease upon Trust nevertheless to and for the Sole and only use of Elizabeth Daughter of the said Samuell Daniell to be paid unto her when Shee shall marry or attaine her age of Twenty One years which shall first happen and my desire is that the said Fifty pounds may be placed out att Interest for her use and benefit, my Will further is that if the said Elizabeth Daniell shall happen to dye before the time of payment and the said mary Daniell shall her Survive then my Will is that the said Mary Daniell shall have the said Fifty pounds and the Interest and produce thereof to be paid at the time and in manner as aforesaid and If the said Mary and Elizabeth shall both happen to dye before the time of payment then I give the said Fifty pounds and the Interest thereof equally amongst their surviving Brothers and Sisters, also I give unto my Grand Daughter Elizabeth Daniell my Silver Tankard my Will and meaning is that the Legacies of One Hundred pounds and Fifty pounds given as aforesaid unto or to the use of my Grandaughters Mary and Elizabeth the Daughters of the said Samuell Daniell is intended to be so given in full satisfaction of One bond or obligation entered into by me unto Samuell Daniell the younger on his Sonns intermarriage with my Daughter Hannah Conditioned to the effect following Viz that I should give as much above or more than Six Hundred pounds unto or with my Daughter Hannah as I should give unto or with my Daughter Elizabeth for her Fortune or portion or to some such or the like effect which bond I desire may be delivered up unto my Executor or otherwise made void on or before the paym[en]t of the said respective Legacies of One Hundred pounds and Fifty pounds, also I give unto my Grandaughter Mary Daniell my least Silver pottinger and two Silver Spoons, also I give unto my Grand Son Samuell Daniell my largest Silver pottinger and two Silver Spoons, also I give unto my Grandaughter Mary Hayne my Second best Silver pottinger and two Silver Spoons, also I give unto my Grandson Nathaniell Hayne my two little Silver Cupps and two Silver Spoons, also I give unto my Grandson Robert Hayne my [Ivydrum ?] Boale brimmed and footed with Silver all which small Legacies I desire may be delivered by my Trustees unto my Grandchildren unto whom they are respectively given, and Whereas by Articles of Agreement made and executed on or before the Marriage of my Son Robert with his now Wife who was one of the Daughters of Nathaniel Butler Dec[eas]ed I have therein and thereby Covenanted and Agreed that my Executor or Adm[inistrato]r within four Months next after my Decease shall pay unto my Son Robert his Executors Adm[inistrator]s or assigns the Summe of four Hundred pounds of Lawfull money which is thereby agreed to be placed orth or disposed of for the use of my said Son for the term of his naturall Life and after his Decease to the use of all and every Child and Children of the said Rob[er]t Hayne on the body of his now Wife to be begotten and for want of such Issue to the use of me the said Jeremiah Hayne my Executors Administrat[or]s and Assigns as by the said Articles will appeare. Now my Will is that the said Four Hundred pounds hall be raised and paid out of my Executory Estate for the severall uses declared in and by the said Articles and If my said Son Robert shall happen to dye without leaving any Issue liveing at the time of his Decease by his now Wife then I give and bequeath the said Four hundred pounds to all my Children that shall be then living equally to be divided amongst them, all other my Goods and Chattles not herein and hereby devised I give devise and bequeath the same and every part thereof unto my said Son Robert and I do make constitute and Appoint my said Son Robert full and Sole Executor of this my Will hereby revokeing all former Wills by me made and I do nominate and Appoint my said Son Samuell Daniell and the aforesaid Paul Jennis Trustees to see this my Will performed and I do give unto each of my Trustees the Summe of Five pounds if they shall act to see this my Will performed In Witness whereof I have hereunto Set my hand and Seale the day and yeare above written
