15 Feb 1777 - Sale of Land

French Grass Ground, Thorney Bush, Fir Tree Ground, New Close and the Three Marle Grounds

 

In his will of 1761, linen draper of the Borough and Hendford Robert Glisson left all his lands, including Larkhill, French Grass Ground, Thorney Bush, Fir Tree Ground, New Close and Three Marle Grounds (Marle Close), to his four daughters - Betty the wife of Richard Manning, Mary the wife of John Wright, Sarah Glisson and Martha Glisson - although ensuring payments from the produce of the rents went to his widow Betty for her life. By 1777, the lands were held by Robert Glisson's daughter Mary, wife of John Wright.

In a Lease for a Year of 14 February 1777, in my collection, Mary leased the lands to her brothers-in-law Richard Manning of Culmstock, Devon, and Robert Winter of Sherborne, Dorset, who had married Sarah Glisson in 1767 (after her father's will). Although Martha had married Thomas Andrews in 1764, neither are mentioned in documentation referring to the lands, since Martha had died in 1767, aged 37.

The following day, this Indenture of 15 February 1777 in my collection, was drawn up, selling the lands to the brothers-in-law for the sum of £840 (around £140,000 at today's value).

The lands, coloured green, owned by Robert Glisson at the time of his 1761 will. He also owned lands in Back Street (today's South Street) the locations of which are presently unidentified.

 

15 February 1777 - Sale of lands

 

This Indenture made the fifteenth day of February In the Seventeenth year of the reign of our Sovereign Lord George the third by the Grace of God of Great Britain France and Ireland King Defender of the faith and so forth and in the year of our Lord One Thousand seven hundred and seventy seven Between Mary Wright of Yeovil in the County of Somersett Widow of the one part and Richard Manning of Culmstock In the County of Devon Gentleman and Robert Winter of Sherborne in the County of Dorsett Mercer and Draper of the Other part Whereas the said Richard Manning and Robert Winter have together Agreed with the said Mary Wright for the Absolute Purchase of the Fee Simple and Inheritance of One Undivided Third Part (the whole in Three equal parts to be Divided) Of and in all and Singular the Messuage Tenements or Dwellinghouse Closes Lands Hereditaments and Premises herein after Particularly mentioned with the Appurtenances scituate lying and being within the Parish of Yeovil aforesaid but subject as herein after his mentioned At all for the price or sum of Eight Hundred and Forty Pounds [around £140,000 at today's value] Now This Indenture Witnesseth that for and in consideration of the sum of Eight Hundred and Forty Pounds of lawful money of Great Britain to the said Mary Wright in hand paid by the said Richard Manning and Robert Winter before the Sealing and Delivery of these Presents in full Discharge of the Purchase money aforesaid (the receipt of which said sum she the said Mary Wright doth hereby Acknowledge and thereof and of every part and parcel thereof doth by these Presents Acquit Exonerate and for ever Discharge the Said Richard Manning and Robert Winter and each of them their and each of their Heirs and Assigns She the said Mary Wright Hath Granted Bargained and Sold Released and for ever Quit Claimed and Confirmed and by these Presents Doth Grant Bargain Sell [revise?] Release and for ever Quit Claim and confirm unto the said Richard Manning and Robert Winter) in their Actual Possession now being by Virtue of a Bargain and Sale for one year thereof to them made and Granted by the said Mary Wright by Indenture bearing date the day next before the day of the date hereof and by force of the Statute for Transferring lifes into possession and to their Heirs One undivided third part (the whole in Three equal parts to be Divided) of and in All that Messuage Tenement or Dwellinghouse And of the Backside and Garden thereto adjoining and belonging scituate and being in a certain Street called the Back Street in Yeovil aforesaid And also Of all those Four Acres and half of Pasture ground (be the same Moore or less) heretofore known by the name of Pen Close but now known by the name of the Orchard lying behind of the said Messuage Tenement or Dwellinghouse and next adjoining to the said Backside and Garden And also of all those Several Pieces or Parcells of Pasture ground in Yeovill aforesaid now inclosed with other Lands herein after particularly mentioned but heretofore two Distinct Closes and then known by the name of Larkhill and containing together by estimation Six acres (be the same Moore or less) which said Messuage Tenement or Dwellinghouse Backside Garden Orchard and Several Parcels of ground called Larkhill and Premises are now in the Occupation of Betty Glisson Widow Mother of the said Mary Wright or her Tenants and what she claimed to hold for the term of her natural Life Also of all those Two Closes or parts or parcells of Two Closes of Pasture ground One of which is now known by the name of the French Grass Ground and the other by the name of Thorney Bush in which said Closes the aforesaid two Closes called Larkhill are now included having been for several years past thrown into and inclosed therewith and made Parts and Parcell thereof and which said Closes including the Larkhill's contained together by estimation Seventeen Acres (be the same more or less) Also of all that Close of Pasture ground now called or known by the name of Firr Tree Ground containing by estimation Eight Acres (be the same more or less) Also of all that Close of Pasture ground now called or known by the name of New Close containing by estimation Two Acres (be it Moore or less) And also All those Three Closes of Pasture ground now called or known by the name of the Marle grounds containing together by estimation Eleven Acres (be the same Moore or less) in which said last mentioned Closes called Marle Grounds or one of them is included One Acre of Ground or thereabouts for many years past inclosed therewith the Fee and Inheritance whereof is by Purchase now Vested in the said Mary Wright Richard Manning and Robert Winter All which said last mentioned Closes called the French Grass Ground Thorney Bush Firr Tree Ground New Close and the Three Marle Grounds are lying and being in the West Field of Yeovil aforesaid and were heretofore known by Different names and for the greatest part were inclosed in the manner they now are by Robert Glisson Deceased late Father of the said Mary Wright who dyed seized of the whole thereof (Excepting the one aforesaid And also of all and all manner of Houses Outhouses Edifices Buildings Backsides Gardens Orchards Rights Liberties Privileges Advantages Emoluments Hereditaments and Appurtenances whatsoever to the aforesaid Messuage Tenement or Dwellinghouse Closes Lands and Premises belonging or in any wise appertaining or therewith now or at or any time heretofore held tied occupied or enjoyed or accepted reputed deemed taken or known as part or parcell thereof And the reversion and reversions remainder and remainders rents issues and profitts thereof And all the Estate Right Title Interest Life Trust Freehold Inheritance Possession Reversion Property Claim and Demand whatsoever both of Law and in Equity of her the said Mary Wright of in to or out of the Premises aforesaid every or any Part or Parcel thereof To have and to hold one undivided Third Part (the whole in three Equal Parts to be Divided) of and in All and Singular the aforesaid Messuage Tenements or Dwellinghouse Closes Pieces and Parcels of Ground Lands Hereditaments and Premises hereby Granted and Released or men's mentioned or intended so to be and of all rights members and appurtenances unto the said Richard Manning and Robert Winter their Heirs and Assigns To the Use and behoof of them the said Richard Manning and Robert Winter their Heirs and Assigns for Ever As Tenants in Common and not as Joint Tenants And the said Mary Wright for herself her Heirs Executors and Administrators Doth by these presents Covenant and Grant to and with the said Richard Manning and Robert Winter and each of them their and each of their Heirs and Assigns in manner and form following (That is to say) That (Saving as herein after is mentioned to be Excepted) She the said Mary Wright at the time of the Execution of these Presents is and standeth Lawfully and Absolutely

Seized of a good Estate of Inheritance in Fee Simple of and in One undivided Third part (the whole in three equal parts to be Divided) of and all and singular the aforesaid Messuage Tenements or Dwellinghouse Closes Pieces and Parcels of Ground Lands Hereditaments and Premises with their Appurtenances And That (saving as aforesaid) She the said Mary Wright hath in herself alone full power good right and lawful and Absolute Authority to Grant Release and Convey such undivided third part thereof unto and to the life of the said Richard Manning and Robert Winter their Heirs and Assigns for Ever in manner and form aforesaid And That they the said Richard Manning and Robert Winter their Heirs and Assigns shall and lawfully may from time to time and at all times for ever hereafter according to the true intent and meaning of these Presents Quietly and Peacefully have hold use occupied possess and enjoy to their own proper use and behoof of the undivided Third part (the whole in three equal parts to be Divided) of the Premises aforesaid being and by these Presents Granted and Released or mentioned or intended so to be Free and clear and freely and clearly Acquitted Exonerated and Discharged or otherwise by her the said Mary Wright her Heirs Executors and Administrators Well and Sufficiently saved Defended kept harmless and Indempnified of from and Against all former and other Gifts Grants Bargains Sales Leases Mortgages Joyntures Dowers uses Wills Entails Judgements Executions Extents Titles Troubles Encumbrances Claims and Demands whatsoever (other than and except such rights as she the said Betty Glisson is that the said Mother of the said Mary Wright hath or claimeth to have for the Term of her Natural Life and in the aforesaid Messuage Tenements or Dwellinghouse Outhouses Backsides Gardens Orchards heretofore called Pen Close and the aforesaid six acres (be the same more or less) lying at Larkhill and now inclosed as aforesaid in the said Two Closes called the French Grass Ground and Thorney Bush And also other than and Except One Annuity or Yearly Sum of Twenty Pounds Given by the said Robert Glisson the said late Father of the said Mary Wright in and by his Last Will and Testament to the said Betty Glisson his Widow for the Term of her Natural Life [For due?] Payment where he Charged All his Lands and which sum has been lately by agreement made payable out of the aforesaid closes called the French Grass Ground Thorney Bush Firr Tree Ground New Close and the Marle Grounds the Third Part of Which Closes is or is intended by these Presents to be conveyed in manner aforesaid And Further that she the said Mary Wright and her Heirs and all and every other person and persons whatsoever having or lawfully claiming or that shall all may have all lawfully Claim any Estate right title or Interest of in to or out of the undivided Third part of the Premises in and by these Presents Granted and Conveyed or meant mentioned or intended so to be (Save and except as aforesaid) shall and will from time to time and at all times hereafter within the space of Twenty years next ensuing the date hereof on the request and at the proper Costs and Charges in the Law of the said Richard Manning and Robert Winter or one of them their or one of their Heirs or Assigns make Do Levy Suffer Execute and Acknowledge or cause or procure to be made done Levied Suffered Executed and Acknowledged all and every such Further and other lawful and reasonable Grants Acts Things and Assurances in of the Law Whatsoever (be it is by fine or otherwise) for the better and more Perfect Granting Conveying and Assuring the same undivided Third part of the premises according to the true intent and meaning of these Presents as by them the said Richard Manning and Robert Winter or either of them their or either of their Heirs or Assigns or their or either of their Counsel Learned in the Law shall be in that behalf most reasonably devised and tended or required And Lastly it is hereby Declared and Agreed by and between the said Mary Wright and the said Richard Manning and Robert Winter and the true intent and meaning of them and also of these Presents is and so it is hereby Declared That all and every Fine and Fines and further and other assurances already had made done Levied Suffered Executed and Acknowledged or to be had made done levyed Suffered Executed and Acknowledged of the said hereby Granted and Released Undivided Third Part of the Premises aforesaid either alone by itself or together any other Lands Tenements or Hereditaments bylaw between the Partys to these Presents or by and between them or any or either of them and any other person or persons whatsoever shall be and [word illegible] and shall be Deemed adjudged construed expounded and taken to be and [word illegible] and are and it is hereby Declared to be and [word illegible] AS touching and concerning the said undivided Third Part of the Premises aforesaid in and by these Presents Granted and Released with the Appurtenances To and for the only proper use and behoof of them the said Richard Manning and Robert Winter their Heirs and Assigns for ever as Tenants in Common and not as Joynt Tenants And to and for no other life intent or war purpose whatsoever In Witness whereof the partys first above named to these presents to have Interchangeably set their Hands and Seals the day and year first above Written
